Delta-8 THC – Is It Legal?

The cannabis plant has continued to grow in popularity over the years. Some of this can be easily attributed to tetrahydrocannabinol (THC) and cannabidiol (CBD). In recent times, savvy cannabis users have started using products featuring a variation of the popular THC compound – Delta-8 THC. This is not an incredibly popular cannabinoid but it comes with some incredible benefits that many manufacturers are beginning to harness.

What is Delta-8-THC? 

If you are familiar with CBD, then you probably have heard a lot about its close relative tetrahydrocannabinol (THC). Just like CBD, THC is also a cannabinoid that is found naturally in the cannabis plant. Delta-8 tetrahydrocannabinol (Delta-8-THC) is a variation of the THC compound. It is also naturally occurring in most cannabis strains but it is only found in small concentrations.

Delta 8 THC is different from the THC. Most times what you refer to as THC is Delta-9 THC.

What’s The Difference between Delta-8 THC and Delta-9 THC?

Delta-9 THC is the main form of THC that is found in the cannabis plant. Delta-8 THC, on the other hand, is said to be a degraded form of THC which is created when THC is stored for a period of time. They both have some similar properties such as stimulating appetite, soothing pain, and reducing nausea. 

The only challenge is that you cannot get to enjoy these benefits from Delta-9 THC without it giving you paranoia or anxiety.

Delta-8 THC is perfect if you are looking for a short uplifting feeling without getting too “high.” It can be psychoactive for some but not as much as Delta-9 THC. In other words, it is a great way to try out some of the effects of Delta-9 THC without diving headfirst into the full experience. 

Delta-8 THC shares the same molecular structure as Delta-9 THC. They are both analog cannabinoids but feature a different placement of the double bond. This is the reason Delta-8 THC exhibits a lower psychotropic potency than Delta-9 THC. 

Is It Legal?

Delta-8 THC is legal to a certain extent. According to the 2018 Farm Bill, hemp-derived cannabinoids are not controlled substances. Also, so long as the product contains less than 0.3% of THC, then it is safe.

Manufacturers like Superstrain source their distillate from renowned US hemp farms. In addition, all of their products contain 0.3% Delta-9 THC or less making them federally legal in the United States. 

If you need to pass a drug test, you should know that it is possible to fail from the using Delta-8 THC. This is because those drug tests do not necessarily test for specific types of THC, rather, they test for THC metabolites. These are the result of the body processing any form of THC.


Delta-8 THC is not easy to come by on the market, and even when you come across it, you have to be careful and pay attention to who and where you buy it from. If you are looking to try out Delta-8 THC, you may want to start off by doing your own research on the legal standing of this cannabinoid in your area.
